1- Western Isles Cruises Ltd gives notice that all arrangements made by us are on the condition that we shall not be liable for any death, injury or damage, loss, delay or irregularity which may be caused by persons or conditions outside our control.
2- We accept no responsibility for any losses or additional expense due to delays in changes in air, road, rail, sea or other services, strikes, war, weather or other causes.
3- The skipper may refuse to carry any passenger or luggage on any charter for any cause relating to the safety of the vessel or any property or other persons on board. In such circumstances the passenger shall not be entitled to any compensation or payment whatsoever except we shall refund to the passenger any fare paid to us in respect of that charter.
4- If owing to circumstances beyond our control, we cannot provide the vessel/charter booked or a suitable alternative, we will refund all money paid, in full, and the passenger shall have no further claim against us.
5- Western Isles Cruises Ltd is insured to cover liability indemnity up to £30,000,000 in respect of any one incident aboard our own vessel. Our insurance does not cover passengers who are away from the vessel or its tender. We do not accept responsibility for loss of or damage to passengers’ gear, property or valuables whilst on board or in transit, so please check your own household insurance cover.
6- No drugs, other unlawful goods or pornographic materials are permitted on board the vessel and the passenger(s) shall free and release Western Isle Cruises Ltd from any liabilities or responsibility arising out of any breach of this condition.
7- In the unlikely event that you have a complaint please report it to us as soon as possible so that we may deal with it promptly and, hopefully, to your satisfaction.
8- We, or a skipper employed by ourselves, reserve the right to vary the charter in any way we consider preferable due to adverse weather or any other conditions. Ultimate decisions regarding the safety of the vessel, its tender and those on board rest with the skipper.
9- Any legal action or proceedings arising out of or connected with this contract shall be governed by the Laws of Scotland.
10- Refunds will only be applicable if a reservation is canceled 24 hours before the due sailing time. The cancellation must be via email or recorded message. It will not be accepted via a verbal conversation with any staff unless staff have confirmed with a return email.
11- The MV Western Isles is a licensed premise’s, ONLY alcohol purchased from the bar aboard can be consumed aboard the vessel.
12- The bar staff have the right to refuse to serve any persons alcohol if they think they are under age or likely to be a danger to the safe operation of the vessel.
13- Passenger are permitted personal luggage, however all food and drink, Kayaks and push bikes will be classed as freight and charged accordingly.
14- Any luggage not traveling with a passenger will be charged at a flat rate of £10 per case.
Were a sailing is full, Western Isles Cruises Ltd have no liability to put on additional sailings.
15- Please ensure you arrive 15 minuets before any sailing and if you have a large amount of luggage please allow 30 minutes.
16- Please note that some sailing may leave a phew minutes before scheduled departure time if all passengers hum are booked on are all present so please book in advance.
17- Please note that space for freight is limited, If you are a large party or have a lot of baggage/freight please try and make the 14:30 sailing as this is often a larger vessel. Bag’s Food and drink will recharged as freight.
